Terms of Service

1. The service
TenderBuilder (Dublin, Ireland) provides software that helps you read, interpret, and respond to Irish public-sector tenders. By creating an account or using the service, you agree to these terms.
2. Your account
You are responsible for keeping your login credentials secure and for any activity under your account. You must be at least 18 and authorised to bind the organisation you are tendering on behalf of.
3. Your content
You retain ownership of everything you upload (company profile, tender documents, drafts). You grant us a limited licence to host, process, and transmit that content to the model provider (Anthropic) solely to deliver the service. We do not use your content to train any model and we do not share it with third parties beyond the sub-processors listed in our Privacy Policy.
4. AI-generated drafts — your responsibility
TenderBuilder produces draft tender responses based on the documents and company profile you supply. You are responsible for reviewing every draft before submission. The service is a writing assistant; it is not legal, financial, or procurement advice. Drafts may contain placeholders, factual gaps, or inaccuracies that you must correct. Submitting a tender response is your decision and your liability.
5. Acceptable use
- Do not upload content you do not have the right to use.
- Do not attempt to reverse-engineer the service or probe other tenants' data.
- Do not use the service to draft a tender response for a buyer where doing so would breach a confidentiality undertaking the buyer has imposed on tenderers.
- Do not use the service for high-risk decisions outside the tender-writing scope.
6. Fees and billing
Paid subscriptions are billed monthly or annually via Stripe in EUR, in advance, beginning on the day you subscribe. We also offer one-off and top-up purchases: a single pay-as-you-go tender (currently €89) with no subscription, and top-up tenders (currently €49 each) that add to the allowance on an active subscription. One-off and top-up purchases are once-off charges, not recurring, and are consumed as tender credits as described on the pricing page. Prices exclude VAT where applicable and may change with notice for future billing periods. You can cancel a subscription at any time via the customer portal; cancellations take effect at the end of the current billing period and we do not pro-rate refunds. Failed payments may result in your subscription being suspended until payment is restored.
7. API access
We offer a programmatic API (including an MCP interface) that lets you and the AI agents you authorise use the service over REST or MCP. The following terms apply to any API or agent use, in addition to the rest of this agreement:
- API keys are credentials. An API key acts for your whole workspace. You are responsible for keeping it secure and for all activity carried out with it, whether by you or by an agent you connect it to. You can revoke a key at any time from Profile → API keys; revocation takes effect promptly. A key is shown once and cannot be recovered, only rotated.
- Programmatic and agent access is subject to the same acceptable-use terms set out in section 5. An AI agent acting under your key is acting as you, and you remain responsible for reviewing every draft before submission (section 4).
- Rate limits and monthly unit allowances apply. API calls are subject to per-key rate limits and to a monthly allowance of metered API units by plan tier, as described on the pricing page and in the developer documentation. These figures are commercial terms, not part of a fixed contract, and may change with notice. The live allowance reported by the API is authoritative.
- Tender-notice data originates from public procurement sources. The tender listings returned by search and match are a cached index of publicly published Irish eTenders notices, provided with attribution for your own bidding use. You may not bulk resell or redistribute the tender-notice corpus, or use it to build a competing listings or index product. Each listing links to its authoritative source, which you should confirm before relying on it.
- We may suspend API access to protect the service — for example in response to abuse, excessive load, a security concern, or a breach of these terms. Where practicable we will give reasonable notice.
- Metered API units and tender credits are as described on the pricing page. Using the API does not create any new billing path beyond the units and credits described there.
8. Service availability
We aim to keep the service available but make no specific uptime guarantee. We may perform scheduled maintenance and may temporarily restrict access if needed for security or capacity reasons. We will give reasonable notice for planned downtime where practicable.
9. Termination
You can delete your account and all associated data at any time from Billing → Account, or by emailing lewis@tenderbuilder.ie. We may suspend or terminate accounts that breach these terms, with notice where reasonable. On termination, your data is removed in line with the Privacy Policy.
10. Limitation of liability
To the maximum extent permitted by law, the service is provided "as is". We are not liable for indirect, incidental, or consequential damages, including lost tenders, lost profits, or reputational harm arising from your use of the service. Our total aggregate liability in any 12-month period is capped at the fees you paid us in that period.
11. Governing law
These terms are governed by the laws of Ireland. Disputes are subject to the exclusive jurisdiction of the Irish courts.
12. Changes
We may update these terms from time to time. Material changes will be notified by email at least 14 days before they take effect; continued use after that date constitutes acceptance.
